when the civil suits are pending for the schedule property prior to the mortgage of the property to the bank,DRT have the rights to grant ORDER to the secured creditor for the possession under the 13 (2) of the SRFAESI ACT 2002 .if not please help me with the DRT previoud judgements.

DRT dont have the powers to attach the property.under section 13[2],notice, you have to give a reply to that notice.There after,the bank will issue possession notice undeer section 13[4] to the barrower, giivng 45 days time to pay the barrowed amount.Against that notice, you have to file an appeal in the DRT court asking for stay.The court will grant stay subject to deposit of some amount. Against the notice under section 13[2], the appeal can not be filed.If filed it will be dismissed as premature.
