As per Supreme Court judgment, the court has no authority to seize a passport...The passport is issued under the Passports Act and therefore only the Passport Dept has an authority to seize or cancel the passport...The law in India is that, when there is a specific provision under a special Act, such as Passports Act in this case, that specific provision supersedes all other general principles of law....I quote here the Supreme Court Judgement for your information: 2008 CRI L.J. 1599 Suresh Nanda Vs. C.B.I.
