Special condition written in a deed
rajeevan_b at 9:14 p.m. on 12 Aug. 12
My mother gave me through DHANA NISCHAYA AADHARAM 10 cents of land for constructing a house. A special condition was written in the document saying that "that land should not be sold outside and if done, it should be sold to my brothers and sisters". The deed was through love and affection. When I appproached a bank for a housing loan, they denied the loan due to the above condition that bank has no right to sell the property due to the above condition. Is the condition legally standing since this is a DHANA NISHCAYA AADHAARAM? Can I sell the property to anybody other than my brothers/sisters? Please advice.
